Until September 7 this year, WTO member countries will not impose retaliatory sanctions against the Ukraine in connection with the operation of 13 per cent premium to the rates of import duties for imports of refrigerators and automobiles.

As the UNIAN correspondent, told reporters, Deputy Minister of Economy of Ukraine Valery Pyatnitsky.

He said that on 24-25 June at the WTO Committee on restrictions imposed in the interest of balance of payments was considered imposed by Ukraine on 13 percent surcharge on import duties only to refrigerators and cars. The subject of consideration by the committee was 13 per cent premium relative to the refrigerators and cars, and its recommendations to the WTO Committee has given exactly for this situation, without taking into account the decision of the Constitutional Court on June 23. If the Committee of the WTO Balance of Payments will want to consider the decision of the Constitutional Court of Ukraine on June 23, it is a separate situation , - explained Pyatnitsky.

He noted that during consideration of the 13-percent surcharge on import duties on cars and refrigerators Committee of the WTO agreed that the allowance would be abolished Ukraine no later than September 7 this year.

According Pyatnitsky, the decision on the possible imposition of retaliatory sanctions against the Ukraine in connection with the renewal of the 13-percent premium, according to the COP, must be preceded by consideration of the matter by WTO members during the 4-month period. We have until the expiration of the 13-percent premium to the import duty is only 2 months, and it has a formal Cabinet decision to repeal these measures as soon as possible. If is assumed that 13 per cent surcharge will apply after September 7, whereas in fact in relation to Ukraine may be imposed retaliatory sanctions by the WTO members, but we will try that this did not happen , - stressed the Deputy Minister.

Responding to the question of whether 13-percent surcharge on import duties today Pyatnitsky encouraged to contact the Customs Service of Ukraine.

In doing so, he believes that the decision by the COP on 23 June does not negate the decision of the Cabinet on 18 March this year to abolish the 13 per cent premium to the rates of import duties for imports of all goods, except refrigerators and cars. The decision only concerns the constitutionality of the COP and not the constitutionality of the legislation, which imposed certain rights to the Cabinet of Ministers, - said Deputy Minister.

As reported by UNIAN, February 20, 2009 Ukrainian President Viktor Yushchenko signed the Law of Ukraine № 923-VI On amending some laws of Ukraine to improve the balance of payments of Ukraine in connection with the global financial crisis. The Act provides for the imposition of a period of six months an interim allowance of 13% to the existing rates of import duty.

This law

Cabinet of Ministers the right to reduce (cancel) the size of the temporary additions to the existing rates of import duties, as well as extend the use of temporary procedures through government action.

Constitutional Court's decision of June 23, 2009 declared unconstitutional legislation under which the Cabinet may decide on the extension of the application, reducing the size, the lifting of the temporary additions to the existing rates of import duties on some products.
